Service Terms
Please review the terms below before accepting them. You can print or save a copy for your records.
1. Scope of Services
Services are those listed in the accepted estimate, service plan, or written work order. Additional or changed work may be quoted separately and requires customer approval before the changed work is performed.
2. Payment Terms
One-Time Services and Projects: Unless otherwise stated in the accepted estimate, an invoice will be provided after the work is completed. Payment must be received no later than 7 calendar days after the invoice date. Any required deposit for materials or larger projects will be stated in writing before work begins.
Recurring Services: Weekly, bi-weekly, monthly, or other recurring services may be billed once per month. The monthly invoice includes services completed during that billing period and must be paid no later than 7 calendar days after the invoice date unless a different schedule is stated in writing.
Late Payment: There is no additional grace period after the payment deadline. If an invoice remains unpaid after the 7-calendar-day payment period, a one-time $10 late fee may be added to that invoice. The fee is charged only once per overdue invoice and does not compound, to the extent permitted by applicable law. Future recurring services may be paused while the account remains past due.
3. Recurring Service Authorization and Billing
If the accepted estimate or service plan provides for recurring service, the frequency, price or pricing method, and billing arrangement will be stated in that estimate or service plan. The customer must affirmatively identify the service as recurring and accept the recurring-service authorization below before recurring service begins.
Recurring service continues according to the agreed schedule until cancelled or changed. It does not guarantee an exact service day when weather, holidays, unsafe conditions, equipment issues, or other reasonable scheduling circumstances require adjustment. Additional work outside the regular service plan will be quoted or approved separately before being added to the invoice.
Recurring-service authorization does not authorize automatic charging of a payment method unless the customer separately agrees to automatic payment in writing.
4. Weather and Scheduling
Service may be delayed, rescheduled, or skipped when rain, saturated ground, unsafe conditions, severe weather, equipment issues, holidays, or other conditions make service impractical or unsafe. Reasonable scheduling adjustments do not cancel the recurring service agreement.
5. Customer Access, Obstacles, and Property Preparation
The customer will provide safe and reasonable access to all scheduled service areas. Before service, the customer should remove or secure pet waste such as dog feces, toys, hoses, lawn furniture, tools, loose debris, children's equipment, temporary decorations, and other movable objects.
The customer should also identify irrigation heads, low-voltage or invisible-fence wiring, landscape lighting, drains, fragile landscaping, hidden objects, and other conditions that may not be readily visible. If customer-controlled conditions prevent safe or efficient work, the Company may skip the affected area, limit the service, or reschedule the affected work. Additional cleanup or labor outside the agreed service may be quoted separately before it is performed.
6. Pets, Gates, and Security
Pets must be secured away from active work areas. The Company will make reasonable efforts to close gates after service, but the customer is responsible for confirming that gates and enclosures are secure before allowing pets outside.
7. Overgrown or Extra Work
Excessive growth, debris, steep terrain, inaccessible areas, hidden conditions, or work outside the agreed scope may require additional labor, hauling, disposal, materials, or pricing. Any material additional charge will be communicated and approved before the added work is performed.
8. Property Conditions and Damage
The Company will use reasonable care while performing services. The Company is not responsible for pre-existing damage or damage caused by hidden, unmarked, deteriorated, improperly installed, or non-visible conditions that could not reasonably be identified before work. This limitation does not apply to damage caused by the Company's negligence or willful misconduct. Customers should report claimed service-related damage promptly so it can be inspected.
9. Debris and Disposal
Normal grass clippings may be mulched or discharged unless bagging or removal is specifically included. Disposal of leaves, branches, brush, bulky debris, soil, or other material may involve additional labor, hauling, or disposal charges if not already included in the accepted quote.
10. Regulated or Licensed Work
This agreement does not authorize pesticide, herbicide, specialty fertilizer, tree removal, structural repair, electrical, plumbing, or other regulated or licensed trade work unless the Company separately confirms that service in writing and any required licensing or certification is in place.
11. Changes and Additional Work
Requests that materially change the scope, quantity, difficulty, schedule, price, or materials should be confirmed in writing before the changed work is performed. Written approval may include a signed work order, text message, email, or other electronic approval from the customer.
12. Cancellation, Termination, and Scheduling Changes
Either the customer or DMV Property Care LLC may cancel or terminate the agreement at any time. The customer remains responsible for all services already completed, approved materials, and other amounts properly due before cancellation becomes effective.
Customer requests to cancel, reschedule, or materially change a scheduled service must be submitted at least 24 hours before the scheduled service time. If no specific time has been assigned, notice must be submitted at least 24 hours before the start of the scheduled service date. A request received less than 24 hours in advance may be subject to a cancellation fee equal to 50% of the scheduled service price.
This fee does not apply when the Company cancels or reschedules, or when service cannot reasonably be performed because of weather, unsafe conditions, or other circumstances outside the customer's reasonable control. For recurring customers, cancelling or rescheduling one visit does not terminate recurring service unless the customer specifically requests termination.
To cancel future recurring service, the customer may call or text (571) 571-6101 or email [email protected]. A cancellation request should identify the customer and service address. Cancellation stops future recurring visits subject to services already completed, approved charges already incurred, and the scheduling notice provisions above.
13. Photos and Marketing
Job-site photos may be taken for documentation. Photos that identify the property for advertising or social media will be used only with the customer's permission.
14. Entire Agreement and Governing Law
The customer service agreement, together with accepted estimates, service plans, work orders, invoices, and written change approvals, forms the agreement for the services provided. If a later written and accepted estimate or change order conflicts with the agreement for a specific job, the later document controls for that specific work. The agreement is governed by the laws of the Commonwealth of Virginia, without limiting rights that cannot legally be waived.
15. Customer Acknowledgment
By checking the Service Terms acceptance box below and continuing to payment, the customer acknowledges that they have read and agree to these Service Terms and authorize DMV Property Care LLC to perform the agreed services. Electronic-transaction consent is requested separately below.
